General policy
DISTANCE SALES AGREEMENT FOR RESERVATION / ACCOMMODATION
ARTICLE 1 – PARTIES

1.1.

This agreement is concluded between, on one side, Va Hotelcilik Tur. San. ve Tic. Ltd. Şti., located at Rasimpaşa Mahallesi Org. Şahap Gürler Caddesi No:66 Kadıköy / Istanbul, phone number +90 538 598 16 74, operating the facility named “Va Pension”, and on the other side the customer/user (hereinafter referred to as “Customer”) who makes a reservation through the system and accepts the following terms in advance by entering and confirming all personal information, including their name, computer IP number, and ID or passport number in the reservation form.

ARTICLE 2 – SUBJECT

2.1.

This agreement covers the Customer’s reservation for the purchase of products/services through the hotel under the conditions described below.

In the event of a price increase in the contract amount, no additional difference shall be requested from the consumer; likewise, discounts referred to as promotions by the facility shall not be refunded to the consumer.

ARTICLE 3 – CONTRACT PRICE AND PAYMENT

3.1. VAT is included in the contract price.

3.2. Room prices including taxes and additional services not included in the price are specified in TURKISH LIRA in the system.

3.3. All services specified in the reservation are included in the contract price. Services not specified and extra products/services received at the hotel are subject to additional charges payable at check-out.

3.4. Customers purchasing discounted or promotional products must pay the full service fee at the time of reservation. The reservation is not confirmed until full payment is made.

3.5. Customers making reservations from abroad via ………. shall pay in foreign currency. Their invoices will be issued in Turkish Lira equivalent calculated using the Central Bank effective selling exchange rate on the day of check-out after accommodation.

3.6. For reservations made via ……………………………………., confirmation and invoice delivery are carried out by the reservation department of Va Hotelcilik Tur. San. ve Tic. Ltd. Şti. as follows:

3.7. Instant reservation confirmation: The confirmation can be printed by the customer at the final stage of the system and will also be sent to the customer’s e-mail address. The invoice will be issued and delivered after the stay is completed and the guest checks out.

3.8. Refunds, where applicable, will be paid within 30 days to the credit card or bank account used for the reservation.

ARTICLE 4 – IMPLEMENTATION

4.1. Without written permission from the hotel management, it is forbidden to bring into the facility items that emit odor, leak, are flammable or explosive, may disturb others, or include cutting/piercing tools or firearms.

4.2. Hotel rules, including check-in and check-out times, are published on the room detail pages of the relevant website.

4.3. The Customer acknowledges that smoking is allowed only on balconies of rooms that have balconies; smoking in rooms without balconies is prohibited, and the Customer agrees to compensate any resulting damage.

4.4. The Customer accepts responsibility for any damage caused to fixtures or equipment in the hotel or common areas during their stay.

4.5. The hotel is not responsible for any loss or damage to the Customer’s belongings or theft of valuables during the stay.

ARTICLE 5 – TERM AND TERMINATION

5.1. The Customer shall stay between the reservation dates. If the Customer wishes to extend the stay, they must notify the hotel at least one day before the departure date. If availability exists, the stay may be extended after payment at current rates; otherwise, the Customer must leave at 12:00 on the reservation end date.

5.2. Reservations made verbally or in writing may be canceled by phone or e-mail. Deductions will be applied according to the contract rules and amounts. The cancellation fee may equal 100% of the reservation amount. Cancellation can only be made using the unique reservation/voucher number and correct personal information provided during booking. The customer is responsible for keeping this number confidential.

Cancellation periods and deduction amounts:

Cancellation 6 days before arrival: free
Cancellation 4 days before arrival: 100% charge
No-Show: the customer cannot request a refund
The Customer accepts these policies as well as TURSAB legislation and international no-show rules and undertakes not to claim any refund from the company.

5.3. The hotel may, with notice to the Customer, partially or fully change or cancel reservations up to 8 days before the start date. If the Customer does not accept this, they may cancel and receive a full refund. No compensation rights arise in this case.

5.4. Except for illness preventing travel or death of the Customer or first-degree relatives documented by an official hospital report, cancellation requests are subject to the deductions stated above.

ARTICLE 6 – FORCE MAJEURE

6.1. The facility shall not be held responsible for inability or deficiency in service due to events such as natural disasters, social unrest, international issues, technical failures, strikes, or protests occurring before or during the reservation dates.

ARTICLE 7 – OTHER PROVISIONS

7.1. This agreement relates solely to hotel reservation services. By confirming the reservation, the facility fulfills its obligations. Any problems must be addressed directly to the accommodation operator.

7.2. If the Customer continues using the service despite complaints, they accept not to request compensation or refunds.

7.3. The Customer must report complaints in writing during service performance. Failure to do so eliminates rights to substitute services or refunds.

7.4. The Customer confirms having read hotel information via the website vapansiyon.com or phone before signing.

7.5. Even if not physically signed, the Customer is deemed to have accepted the contract if informed via website, announcements, or e-mail.

7.6. If there is a discrepancy between copies, the hotel’s copy prevails. E-mails, faxes, and phone messages constitute definitive evidence, and company records prevail.

7.7. The Customer may obtain travel insurance covering return costs, accident damages, or treatment expenses.

7.8. Identity and age checks are carried out at check-in. Differences due to incorrect statements are collected at the entrance. Guests aged 6 and above are considered adults.

7.9. Price increases do not require additional payment from the Customer, and discounts applied later are not refundable.

7.10. The hotel may send campaigns and notifications to the Customer’s contact details; by signing, the Customer grants permission.

7.12. In disputes, the Customer may apply to Consumer Courts or Arbitration Boards. Prior written complaint to the hotel and a 14-day response period are considered good faith.

ARTICLE 8 – COLLECTION

8.1. By this document, I authorize Va Hotelcilik Tur. San. ve Tic. Ltd. Şti. to charge my credit card for the reservation amount. If payment cannot be collected, I accept to pay with interest at credit card rates. I confirm that I have read, understood, accepted, and received copies of this 5-page, 11-article agreement and will send the signed copy to vahotelcilik@gmail.com.

ARTICLE 9 – PROTECTION OF PERSONAL DATA

9.1. Personal data such as name, surname, e-mail, gender, hometown, financial data, IP information etc. may be processed, stored, used, updated, shared, or transferred by the Hotel, its affiliates, or third parties for purposes including service provision, development, system troubleshooting, payment processing, updating customer data, managing reservations, and fulfilling contractual obligations.

9.2. Necessary technical measures are taken for data security within the hotel’s system infrastructure. However, since data is entered from the customer’s device, the customer is responsible for protecting it against unauthorized access or malware.

9.3. The Customer may request cessation of data processing or communications. Upon request, data will be deleted, anonymized, or corrected within legal limits, and the Customer may exercise all rights granted under data protection law.

ARTICLE 10 – DISPUTE RESOLUTION

Consumer Arbitration Committees or Consumer Courts at the place where the service was purchased or where the consumer resides are authorized, within limits announced by the Ministry of Trade and according to Article 68 of Law No. 6502.

ARTICLE 11 – EFFECTIVENESS

This agreement consisting of 11 articles enters into force when approved electronically by the Customer on the reservation/payment date.
